Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Luma mobile application (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the App or its content.

3. Account & Access

Certain features of the App may require an active subscription. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

4. Subscriptions & Payments

Luma offers the following subscription tiers:

• Free: Access to select templates, standard quality edits, local gallery storage, and camera integration.
• Pro: All templates unlocked, unlimited AI generations, custom prompt editing, all aspect ratios, and priority processing. Billed at $4.99/week with a free trial period.

All payments are processed through the Apple App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your App Store account settings.

5. User Content

You retain full ownership of the photos you upload and edit using the App. By using our AI editing features, you grant us a limited, temporary license to process your photos solely for the purpose of delivering the editing service. We do not claim any ownership rights over your content.

6. Intellectual Property

The App, including its design, features, AI models, templates, and all related intellectual property, is owned by Luma and protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works based on the App without our prior written consent.

7. Prohibited Uses

You agree not to:

• Use the App to generate illegal, harmful, or misleading content
• Attempt to reverse-engineer, decompile, or extract source code from the App
• Use the App to infringe on the intellectual property rights of others
• Circumvent or attempt to circumvent subscription restrictions or access controls
• Use automated scripts or bots to interact with the App
• Use the App in any way that could damage, disable, or impair our services

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that AI-generated results will meet your specific expectations.

9. Limitation of Liability

To the maximum extent permitted by law, Luma shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App or on our website. Your continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
